By creating an account with AtCommerce, you confirm that you are in agreement with and bound by the following terms and conditions.

ATCOMMERCE IS ONLY WILLING TO PROVIDE ECOMMERCE SERVICES TO YOU UPON THE CONDITION THAT YOU ACCEPT ALL OF THE TERMS CONTAINED IN THIS AGREEMENT. PLEASE READ THIS AGREEMENT CAREFULLY AS IT AFFECTS YOUR LEGAL RIGHTS AND REMEDIES.

The following agreement (“Agreement”) is entered into between you (“User” or “you”) and AtCommerce (“AtCommerce”, “we” or “us”) and is made effective on the date of electronic acceptance. By signing up for the AtCommerce service (“Service”), you are agreeing to be bound by the following terms and conditions (“Terms of Service”). Any new features or tools which are added to the current Service shall be also subject to the Terms of Service. AtCommerce reserves the right to update and change the Terms of Service by posting updates and changes to the AtCommerce website. You are advised to check the Terms of Service from time to time for any updates or changes that may impact you. All other terms are applicable.

Account Terms 

1. You must provide your full legal name, current address, a valid email address, and any other information needed in order to complete the signup process.
2. You are responsible for keeping your password secure. AtCommerce cannot and will not be liable for any loss or damage from your failure to maintain the security of your account and password.
3. You may not use the AtCommerce service for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws) as well as the laws of Pakistan.
4. You are responsible for all activity and content (data, graphics, photos, links) that is uploaded under your AtCommerce account.
5. You must not transmit any worms or viruses or any code of a destructive nature.
6. A breach or violation of any of the Account Terms as determined in the sole discretion of AtCommerce will result in an immediate termination of your services.

General Conditions

You must read, agree with and accept all of the terms and conditions contained in this User Agreement before you may become a member of AtCommerce.

1. We reserve the right to modify or terminate the Service for any reason, without notice at any time.
2. We reserve the right to refuse service to anyone for any reason at any time.
3. Your use of the Service is at your sole risk. The Service is provided on an “as is” and “as available” basis without any warranty or condition, express, implied or statutory.
4. AtCommerce does not warrant that the service will be uninterrupted, timely, secure, or error-free.
5. AtCommerce does not warrant that the results that may be obtained from the use of the service will be accurate or reliable.
6. We may, but have no obligation to, remove Content and Accounts containing Content that we determine in our sole discretion are unlawful, offensive, threatening, libelous, defamatory, pornographic, obscene or otherwise objectionable or violates any party’s intellectual property or these Terms of Service.
7. AtCommerce does not warrant that the quality of any products, services, information, or other material purchased or obtained by you through the Service will meet your expectations, or that any errors in the Service will be corrected.
8. You expressly understand and agree that AtCommerce shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses resulting from the use of or inability to use the service.
9. In no event shall AtCommerce be liable for lost profits or any special, incidental or consequential damages arising out of or in connection with our site, our services or this agreement (however arising including negligence).
10. You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service without the express written permission by AtCommerce.
11. Verbal or written abuse of any kind (including threats of abuse or retribution) of any AtCommerce customer, AtCommerce employee, member, or officer will result in immediate account termination.
12. We do not claim any intellectual property rights over the material you provide to the AtCommerce service. All material you upload remains yours. You can remove your AtCommerce store at any time by deleting your account. This will also remove all content you have stored on the Service.
13. By uploading images and item description content to AtCommerce, you agree to allow other internet users to view them and you agree to allow AtCommerce to display and store them and you agree that AtCommerce can, at any time, review all the content submitted by you to its Service.
14. The failure of AtCommerce to exercise or enforce any right or provision of the Terms of Service shall not constitute a waiver of such right or provision. The Terms of Service constitutes the entire agreement between you and AtCommerce and govern your use of the Service, superseding any prior agreements between you and AtCommerce (including, but not limited to, any prior versions of the Terms of Service).
15. You retain ownership over all content that you submit to a AtCommerce store however, by making your store public, you agree to allow others to view your content.
16. AtCommerce reserves the right to display AtCommerce and NopCommerce or AtCommerce and NopCommerce logo in the footer of your AtCommerce store. You agree not to remove the AtCommerce logo from your website footer without the written permission from AtCommerce.

Cancellation and Termination

1. You may cancel your account at any time by emailing us.
2. Once your account is cancelled all of your Content will be immediately deleted from the Service. Since deletion of all data is final please be sure that you do in fact want to cancel your account before doing so.
3. Fraud: Without limiting any other remedies, AtCommerce may suspend or terminate your account if we suspect that you (by conviction, settlement, insurance or escrow investigation, or otherwise) have engaged in fraudulent activity in connection with the Site.

Payment of Fees

1. AtCommerce will charge you the service fees and transaction fees against your selected subscription plan.
2. For transaction fees, you will be billed a percentage of the total amount of successful orders processed in a given period of time.
3. The service will be billed either in 1 month, or 12 months intervals, whichever interval you choose.
4. Any outstanding amount that has yet to be charged will be charged to you on the next billing date. Fees will be shown on an invoice sent to the store owner via email. Users have approximately to bring up and settle any issues with the billing.
5. If we do not receive the outstanding bill payment within 30 days of the bill invoice, we may suspend access to your Account and the Services. However, your Account will be reactivated upon payment of the outstanding bills. You may not be able to access your Account or your store during the period of suspension.
6. If the subscription charges or transaction fees remain unpaid for 60 days after the due date, AtCommerce reserves the right to take necessary actions, including denying access to the admin area, restricting viewing of received orders or terminating your store.
7. AtCommerce does not provide any partial or full refunds.

Fair use policy

1. Resource usage: You are responsible for ensuring that your use of the Service does not exceed the available resources, including storage, bandwidth, and other resources. We reserve the right to limit or terminate your access to the Service or any portion thereof if you exceed these limits.
2. Abuse: We reserve the right to suspend or terminate your access to the Service if we reasonably believe that you are using the Service in a manner that violates this Fair Use Policy or applicable laws, or if you engage in any conduct that we determine, in our sole discretion, to be abusive, inappropriate or harmful.
3. If we deem your account inactive, we will notify you via the email address associated with your account. The notification will include information on the impending closure of your store and a reminder that you have 30 days to log in and use the platform before we close your account. It is important to note that once your account is closed, all associated data will be deleted and cannot be retrieved.
4. To keep your account active and avoid any unexpected closures, ensure you regularly log in to your account and engage with your customers. This can include updating your store with new products, responding to customer inquiries, and promoting your store through marketing channels.
5. We reserve the right to modify or update this Fair Use Policy at any time without prior notice. Your continued use of the Service after any such changes constitutes your acceptance of the new Fair Use Policy.

Modifications to Prices

1. AtCommerce shall not be liable to you or to any third party for any modification, price change, suspension or discontinuance of the Service.
